THU: SEALED GULSON TESTIMONY BEGINS–UPDATE 5

UPDATE 5: 5:20 PM: Court finished quite late this afternoon. No further information could be obtained, although it may be assumed Mr. Gulson has finished testifying. He appeared in good spirits.

UPDATE 4: 3:40 PM: Court has taken a very late break this afternoon. It appears Mr. Wallace’s cross was lengthier than anticipated. Since Mr. Gulson must be finished today, court could run to 5PM or later.

UPDATE 3: 12:50 PM: Court has broken for lunch. Mr. Wallace has another 30″ of cross left. Mr. Bass will then cross for 10-15″.

UPDATE 2: 11:23 AM: Mr. Wallace’s cross will continue after the late morning break. Observers think the testimony will continue to the early afternoon, possibly ending by the lunch break (usually taken at about 1PM).

Adverse witness Jerry Whidby, a current Philip Morris consultant, is scheduled to testify next, but probably will not be called today.

As promised, Courtroom #19 was sealed at 9:25 AM this morning for the testimony of Frederic Gulson. Even the DOJ’s Stephen Brody and Lorillard’s Michael Minton were left out in the hallway briefly, until the door could be opened from the inside.

Panels were placed over the doors’ 2 small windows, thwarting even lip-reading reporters.

The DOJ’s Brett Spiegel will handle the Government’s direct examination, while BAT Investments Ltd.’s David Wallace (Chadbourne & Parke) will cross-examine Mr. Gulson. It is possible B&W’s Ken Bass (Kirkland & Ellis) may also cross.
