Next Up: Bradley On ETS; Hold On To Your Stats!
March 14, 2005 1:05 pm by Gene Borio“I found this testimony extremely challenging,” said Judge Kessler this morning about statistician/biostatistician Dr. Edwin L. Bradley’s Written Direct Testimony on ETS. “I feel as if I’ve taken the entire judges’ Berklee Seminar on Statistics in 142 pages.”
The DOJ’s David Klein wanted to have Dr. Bradley’s opinions on “biological plausibility” thrown out. Dr. Bradley criticizes Dr. Samet’s findings from the 2004 Surgeon General’s Report which consider “biological plausibility” in determination of ETS’s risks. Mr. Klein said it was inappropriate for a statistician to criticize the medical expertise of Dr. Samet.
Judge Kessler allowed Dr. Bradley’s testimony in, with this characterization: “Dr. Bradley testifies that in his field that it is inappropriate to consider biological plausibility.” Her understanding seems to give a much more limited scope to the testimony than the Defense would like, I am sure.
Lorillard’s Michael Minton will handle the examination for the Defense. Stephen Brody will cross for the DOJ.
