WEINSTEIN TO PLAINTIFFS: DROP ESTOPPEL ARGUMENTS

Judge Weinstein has reached a decision in the Schwab case.

According to a Reuters report, he sent a note Friday to the parties that he would rule Monday morning by 10 AM.

He issued a seemingly related order in a very odd way: scrawled atop Plaintiffs’ September 19 letter on collateral estoppel. The handwritten note reads,

“Notify: no further briefing is required. So ordered

“JW

“9/21/06″

The so-encumbered letter was offered as an accompaniment to Friday’s docket entry #1005, which reads:

“ORDER: no further briefing is required (re: the collateral estoppel issues). Ordered by Judge Jack B. Weinstein, on 9/21/2006. (Endorsed on letter dated 9/19/2006 from Benjamin D. Brown to USDJ Weinstein) (Barrett, C.) (Entered: 09/22/2006)”
